GNAT (AA) – KEMAL KARADAĞ – GNAT Justice Commission Member and AK Party Istanbul Deputy Şengül Karslı, regarding the Constitutional Court’s annulment of the “indefinite alimony” regulation, said, “This decision does not mean that alimony has disappeared. Stating that the Supreme Court annulled the phrase “indefinitely” regarding the poverty alimony stipulated in the first paragraph of Article 175 of the Turkish Civil Code, Karslı stated that the annulment decision will come into force 9 months after its publication in the Official Gazette. Reminding that the reason for the decision will be announced later, Karslı continued as follows: “This decision does not mean that alimony has been abolished.

The law continues to be in force in its current form as alimony will be awarded to the parties in need of alimony. The current arrangement will continue until the annulment decision comes into force. There will be no change in the existing cases and the cases to be heard. Alimony payments will not be cancelled, accumulated debts will not be erased, and there will be no negative impact on enforcement. In my opinion, the Constitutional Court wanted to prevent automatic, indefinite and lifelong liability with this decision.

“If the task of regulation falls to the legislative body in the future, our priority will be to protect the party that will fall into poverty for this reason, and to make equitable regulations that protect women and children, do not victimize them, but will not cause victimization for both parties.” Expressing that judges will continue to award alimony to those who need alimony, Karslı emphasized that no one should doubt that equitable regulations will be made to protect women and children within the scope of legal predictability and certainty principles when needed at the end of the process.

Şengül Karslı noted: “Alimony has not disappeared. The decision consists of removing the phrase ‘indefinitely’. We can say that the purpose of the Constitutional Court here is to evaluate it with the correct criteria before sentencing it to an automatic, indefinite, life-long liability, and to direct it to make a decision that determines the duration accordingly, if necessary. With the decision of the Constitutional Court stating that it will come into force 9 months after its publication in the Official Gazette, alimony has not been eliminated in any way.
