The Constitutional Court annulled the “indefinite alimony” regulation

The Constitutional Court (AYM) annulled by majority vote the regulation regarding indefinite alimony to the divorced spouse.

In today’s General Assembly agenda, the Constitutional Court discussed the application made by the Antalya 12th Family Court for the annulment of the regulation regarding the “indefinite nature” of poverty alimony, which is stipulated in Article 175 of the Turkish Civil Code No. 4721.

According to the information obtained, the Supreme Court decided by majority vote to annul the relevant regulation and that the annulment provision would come into force after 9 months. The justification for the decision will be written later.

Article 175 of the Turkish Civil Code, titled “alimony in poverty”, states: “The party who will fall into poverty due to divorce may request alimony from the other party indefinitely, in proportion to his financial means, provided that his fault is not more severe. No fault is required on the part of the alimony obligor.” It contains the provision.
