The First 5 Articles of the Bill Containing Agriculture and Forestry Regulations were Accepted in the Grand National Assembly of Turkey

The first 5 articles of the bill covering agriculture and forestry regulations, which were discussed in the General Assembly of the Turkish Grand National Assembly, were accepted.

While the discussions on the proposed law, which envisages various regulations in the fields of agriculture and forestry, were continuing in the General Assembly of the Grand National Assembly of Türkiye (TBMM), the first 5 articles of the proposal were accepted. While the distance criteria for paddy cultivation areas were updated within the scope of the regulation, new provisions were also introduced for the promotion and sale of alcoholic beverages.

Negotiations on the Soil Conservation and Land Use Law and the Bill on Amendments to Some Laws, which were discussed in the General Assembly of the Turkish Grand National Assembly, have been completed. Representatives of political parties made evaluations regarding the content of the proposal and its preparation process. During the negotiations, opposition parties argued that sufficient impact analysis was not carried out during the preparation of the proposal and that various articles were legally controversial.

Criticisms were expressed about the proposal, especially regarding its regulations regarding agricultural lands, forest areas and property rights. Representatives of the ruling party stated that the regulation includes the changes needed in areas such as sustainability of agricultural production, protection of natural resources, food supply security and combating climate change. It was stated that within the scope of the proposal, there are provisions for protecting public health, resolving property disputes arising from the forest cadastre and strengthening the legal structure of Atatürk Forest Farm.

New Distance Conditions for Paddy Cultivation Areas Among the articles accepted was the amendment to the Paddy Cultivation Law. With the regulation, the distance of paddy fields to residential areas was redefined. According to the new provisions, paddy cultivation areas will be at least 500 meters away from the zoning border in provincial and district centers. In villages and neighborhoods, this distance will be 50 meters.

The distance calculation will be based on the outermost house in the settlements and the closest point of the paddy cultivation area. Promotion Restrictions on Alcoholic Beverages Have Been Expanded Within the scope of the proposal, the Alcohol and Spirited Beverages Exclusion Law has also been amended. According to the new regulation, companies that produce, import or market alcoholic beverages; will not be able to support any event using the visuals on the brand, logo, emblem and product packaging.

Restrictions were also imposed on the brands and visuals in question being kept in event areas, workplace windows and sales points. In addition, the use of fermented and distilled alcoholic beverage brands in each other’s categories will be prevented. Delegation of Authority in Sales Prohibition Control Within the scope of the regulation, the authority to impose administrative sanctions for violations of the retail alcohol sales ban implemented between 22.00 and 06.00 throughout the country will be transferred to local administrative authorities.

Businesses that sell alcoholic beverages retail or openly will be given 1 year from the effective date to comply with the new provisions. Products within the scope of the regulation will need to be brought into compliance with the new rules within 3 months. Tax Exemption Regulation for Atatürk Forest Farm Among the articles accepted was the amendment made to the Atatürk Forest Farm Law. The aim of the regulation is to ensure uniformity in the application of exemptions in terms of building and land taxes for immovable properties registered in the name of farms.

In addition, Atatürk Forest Farm Directorate will be exempt from some judicial fees and tax jurisdiction fees. General Assembly Works were Suspended. After the 5 articles in the first part of the proposal were accepted, the Advisory Board proposal was put to vote at the GNAT General Assembly. In line with the accepted proposal, it was decided not to reconvene the General Assembly on the same day.
